1. Terms and Conditions Acceptance
The use of this web site and the services offered by Pelican S.A. and santorinivillas.net (Internet travel agency) are subject to the following Terms and Conditions.
Santorinivillas.net terms and conditions are applied to all the reservations made by the customer of santorinivillas.net. Your use of this site is expressly conditioned on your acceptance of the following terms and conditions. By using this site, you signify your assent to these terms and conditions. If you do not agree with any part of the following Terms and Conditions, you must not use this site.
2. Services
Pelican S.A. provides a web site, which offers tourism products and services. Pelican S.A. acts as an intermediary between santorinivillas.net and third party providers for villa reservations. These services are offered by different providers each time and this is clearly stated either in the process of reservations and/or sale or in the final reconfirmation of it.
You can buy a product or book a service only if there is availability for this particular product or service.
In case of reservation, the contract agreed is binding for the end user and the provider of the corresponding product or service.
Pelican S.A. and santorinivillas.net are solely responsible for the mediation between the clients and the providers. The providers are the only ones to assume full responsibility for any agreements made through santorinivillas.net.
3. Reservation
After filling-in the corresponding fields of the reservation form and the successful completion of the reservation, the customer authorizes santorinivillas.net to act as an intermediate for the service provided by the corresponding provider or for any other service related. The reservation order is in any case binding for the user.
The providers assume full responsibilities in case any of them postpone or cancel any flight itinerary, ferry trip, or , in general, in case of any unexpected change of the terms agreed with the user for the service provided. santorinivillas.net assumes no responsibility for such changes by the providers. Nevertheless, santorinivillas.net will try to contact the customer as soon as possible concerning any unexpected changes.
The user is responsible to adhere to the terms set by corresponding providers. The user is always notified regarding these terms by the corresponding provider.
4. Confirmation of reservation and shipping of travel documents
In case of reservation through santorinivillas.net, the user will receive confirmation for that reservation by e-mail from santorinivillas.net or directly by the provider.
The user is obliged to check immediately the validity of the confirmation details (name, date of departure/return, destination, days of hire etc.) and to notify santorinivillas.net for any mistakes. Mistakes that are reported to santorinivillas.net 48 hours or later after the confirmation will not be taken into account.
santorinivillas.net assumes no responsibility for any loss of travel documents sent by mail or courier.
In case of hotel reservations or car rentals, no travel documents are sent to the user. Instead, the user received an e-mail with the reservation details. Upon arrival, the user shows the reservation code to the hotel or to the car rental office.
5. Charges
The final rates of the services and products offered by santorinivillas.net include reward for mediation of santorinivillas.net for these services and products.
The providers always send the price lists and charges to santorinivillas.net. santorinivillas.net assumes no responsibility for any changes of the prices and rates made by the providers.
santorinivillas.net assumes no responsibility for any reservation fees imposed by the provider in case of cancellation of a reservation or a service. Those fees have to be paid solely by the user.
6. Payment methods
Every single product and/or service corresponds to different payment methods and those are clearly written on the web site of santorinivillas.net. Only the suggested by santorinivillas.net payment methods will be accepted. The user's credit card details will be used as guarantee for the reservation. In some cases, the user receives the final confirmation of the reservation and the total amount by the provider; that final amount can be paid by credi card, by cash or through bank transfer. In case of credit card payment, written assent is should be necessarily provider by the card owner.
santorinivillas.net is not obliged to send travel documents to the user before the final payment of the corresponding fee. In any case, the customer is obliged to make a final payment for the products and/or services he has ordered from santorinivillas.net.
santorinivillas.net may ask the user to present proof of residence or credit card details or copy of bank transfer transaction via FAX or by mail before the final confirmation of the reservation.
santorinivillas.net reserves the right to send the confirmation of reservation, vouchers or other travel documents only to the address registered in the bank accounts or in the publisher accounts of the credit card.
In any case, in order for a transaction to be completed, the user must accept the terms and conditions mentioned in that specific page of the transaction.
7. Cancellations, changes
The possibility of change or cancellation of any product or service along with the corresponding terms and conditions for such a change or cancellation are determined solely by the terms imposed by the providers. santorinivillas.net has no influence upon these terms.
The user will be the only party to pay any fee related to change or cancellation of a travel service set by the provider.
In case that the provider allow the user to change or cancel a product or service offered, then the user must notify santorinivillas.net in written whether he wishes to have such a change or cancellation.
santorinivillas.net cannot cancel or modify any reservation, unless it receives written authorization by the customer, as stated above.
The service fee of santorinivillas.net is non-refundable in case the user cancels or modifies a reservation, or deny to receive the service or product ordered. In such cases, santorinivillas.net reserves the right to claim additional cancellation fees.
Please, bear in mind that there is a possibility of no availability of a specific service or product at the time of the request. In any case, we will make strong efforts to satisfy your request as soon as possible.
8. Rejection of reservation
santorinivillas.net reserves the right to reject a reservation ordered by a user, in case the latter does not conform to the terms and conditions of santorinivillas.net.
9. Limitation of liability
santorinivillas.net assumes no responsibility, and shall not be liable for, any damages to, or viruses that may infect your computer equipment or other property on account of your access to, use of, or browsing in this site or your downloading of any materials, data, text, images, video or audio from the site. In no event shall santorinivillas.net or any third party providers or distributors be liable for any injury, loss, claim, damage, or any special, exemplary, punitive, indirect, incidental or consequential damages of any kind (including, but not limited to lost profits or lost savings), whether based in contract, tort, strict liability, or otherwise, which arises out of or is in any way connected with (i) any use of this site or content found herein, (ii) any failure or delay (including, but not limited to the use of or inability to use any component of this site for reservations or ticketing), or (iii) the performance or non performance by santorinivillas.net ltd or any third party providers or distributors, including, but not limited to, non performance resulting from bankruptcy, reorganization, insolvency, dissolution or liquidation even if such party has been advised of the possibility of damages to such parties or any other party.
If, notwithstanding the foregoing, santorinivillas.net or any third party provider or distributor should be found liable for any loss or damage which arises out of or is in any way connected with any of the above described functions or uses of this site or its content, the liability of santorinivillas.net and the third party providers and distributors shall in no event exceed, in the aggregate, the greater of (a) the subscription fee and service charge for accessing this site, or (b) 100.00 Euros. This agreement and its performance shall be governed by the laws of Athens, Greece, without regard to its conflicts of law provisions. You consent and submit to the jurisdiction of the state and federal courts located in Athens, Greece, in all questions and controversies arising out of this agreement and your use of the site.
13. Modification
